Landlord Discussion[ Contents | Search | Post | Reply | Next | Previous | Up ] Electrical safetyFrom: I CommentsElectrical safety, grey area you would say, not covered by legislation? Look closely-safety regs94 and plugs and sockets 94- state that supplying unsafe elec goods is an offence, when an unsafe appliance is found in rented accom trading standards check that llord or agent has taken all reasonable precautions eg:Portable appliance test or full installation report and reccommendations. Consumer protection act 87- an offence can be commited before a contract is signed if a llord supplies faulty elec items. Unfair contract terms 77- stipulates that if you do business using standard form contract then your terms should be reasonable, llords cannot exclude liability for death or injury resulting from negligence. Supply of goods and services 82, if you have a contract to supply a service then it is implied that you will carry it out with reasonable care and skill, any goods supplied should be of satisfactory quality, durable free from defect and fit for purpose. Under due diligence, any defence is likely to fail if there was a reasonable step that could have been taken but was not , it is important to show that any failures have been acted upon and changes made to prevent similar occurences- ELECTRICAL TESTING NOT COVERED BY REGULATIONS-YOU DECIDE, Any advise mail sarian@btconnect.com
