Thanks for the message.

Your solicitor will be able to guide you through the process. If the tenant is currently two months in arrears the courts will automatically give you possession, though it can take a while to get to court. Not signing the tenancy agreement is fine as long as you have a copy that you can give to your solicitor - tenancies nowadays usually come under The Assured Shorthold whether or not they have been signed.
