incomplete tennancy agreement & tennant in arrears

i have a bad tennant who knows the game & is in arrears of 2-3 mnths i have just heard from court who say my s/hold tennancy agreement is incomplete & i havent issued a section 21 which i believe i have . if my tennancy agreement is incomplete wot rights do i have & the tennants can i get rid of them many thanks please help cos i need advise thanks louise
