Have spoken to Gravesham Housing today - lady called Karen and she said that they would not re-house your tenant until she gave them a possession order because a tenant does not have to legally move until there is a possession order, regardless of Section 21 etc. Should the tenant be behind in the rent then you can get an Acceleratwd possession order in the County Court under Ground 8 - 2 months in arrears etc. Strange this as you would think they are encouraging the tenant to be as difficult as possible - but in a way I guess they are right in that even though you give the tenant a section 21 notice the tenant still does not have to move until you get a possession order - it is only because tenants are either ignorant of their rights or a not so pedantic as others that we do not come across this very much.
