Termination of "Periodic Tenancy"

I let my property through an agent who appears to have let the period of tenancy lapse. The tenant has continued to live in the property for several months but now wants to give one months notice to leave (and not from a pay day!) The agent didn't warn me about this and is suggesting that its my fault for not getting the tenant to renew his contract period! What rights do I have from a) the tenant, can I insist he pays 2 months rent as per the old contract terms, or b) claim my loss against the agents for allowing this situation to arise! Cheers.
