Firstly your agent should have issued a Section 21 at the beginning of the tenancy (after it has started) that way the onus is on the tenant to request renewal - it is not however law that this should be done, just good practice. If your agent was not managing the tenancy then the onus is on you to re-negotiate the contract. As for claiming 2 months rent, this depends on how much notice the tenant has to give you i.e. one months notice = i month's rent. To get 2 months rent out of the tenant will be hard anyway as the tenancy is now periodic, runnning from one period of rent to the next i.e. monthly. Sounds to me like your agent is not particularly clued up and has let you down but that the onus is on you to know when the tenancy was due to expire etc. Please contact me if I can be of any further assistance.
