"Pre-dated Notice" trick - any thoughts?

I posted recently concerning a couple who had split, with the husband doing a runner leaving wife in situ and two months owing...

Served notice today - to her and to his new address. Had a good chat with her and it seems he told her he was going to post me a letter saying he was giving notice, but pre-dating it to when he left a few months ago.

Any thoughts on how many laws he will be breaking, and how to prevent the trick from working?

Also, the wife says she may have a cheque from him for one of the month's rent. Should I ask her for it, or would taking his cheque from her imply that the has a tenancy agreement with me?

Stop press news! Since starting to type this message, the man has got a message to me saying he will e-mail me giving me a month's notice and will be paying the outstanding rent! Result!? Here's hoping... I'll believe it when the cheque's cleared...
