Hi Auto. Typical council I'm afraid - you give them a property to help them out with their housing situation and all they tend to do is screw you any which way they can. To be honest they are right you need a court order to evict the tenant - note however normally notice will suffice with your ordinary decent, honest tenant but rarely with a DSS tenant. Serve notice again, and get in touch with a solicitor who will be able to walk you through the possession process.
